After a brief history of the legal aspects of religious assistance in Brazilian prisons and the presentation of data about religious filiations of imprisoned people, this paper identifies, through a cultural analysis of the right to religious assistance and bibliographical research, how penal institutions, imprisoned people and religious assistants use this right. It concludes that such uses exceed the objective of the legal provision which is the religious assistance.
