REFLECTIONS ON THE GUARANTEE OF THE RIGHT TO RECEIVE RELIGIOUS ASSISTANCE IN PUBLIC INSTITUTIONS IN PERU

This paper takes as starting point the fact that Peruvian church and state system is a cooperative model, which allows religious assistance at public institutions. Nevertheless, once we analyze the regulation it is obvious that some deficiencies became latent obstacles for a real protection of religious freedom as human right. From there, a state described as neutral concerning religious faith, but with the purpose to collaborate with all religious denominations, has the obligation not just to guarantee but to promote and effective fulfillment of its citizen’s right to receive equal religious assistance at public institutions, otherwise this church and state model must be described in a different way.
